Most websites today use so-called cookies to improve the user experience. A cookie is a text file that, when visiting or interacting with a web page, is stored in your browser's internal memory. The revised Electronic Communications Act requires that Electrocompaniet informs the public about the use of cookies. The so-called "cookie clause" states the following:

§ 2-7b Use of cookies

Storage of information in the user's communication equipment, or access to such, is not permitted without the user being informed of what information is being processed, the purpose of the processing, who is processing the information, and has consented to this. The first sentence does not preclude technical storage of or access to information:

1. solely for the purpose of transmitting communications in an electronic communications network

2. which is necessary to provide an information society service at the explicit request of the user. Electronic Communications Act § 2-7bshall help to ensure the users' privacy in the electronic communications area. The provision is mainly aimed at privacy-infringing techniques such as spyware and the like and is not intended to constitute an obstacle to the use of legal techniques.

The provision protects the user's communication equipment, in that there is a stricter requirement for information and consent from the user if cookies are to be used. Storage of information and processing of this information is not permitted unless the user has been informed of, and has consented to, what information is processed, what the purpose of this processing is and who processes the information.

It is therefore a prerequisite for the use of cookies that the end user has consented to the use. Provided that there is clear and unambiguous information available on the relevant website about which cookies are used, which information is processed, the purpose of the processing and who processes the information, consent can be given by the end user using a technical setting in the browser or similar in cases where this is technically possible and efficient.

Presetting in the browser that the user accepts cookies is considered consent. It is sufficient that the user consents once for the same purpose. The user shall at all times have the opportunity to withdraw his consent.

The requirement for clear and distinct information is considered fulfilled when: 

  • The information is easily visible as soon as the user enters the website. That is, either a link to information in the header, text box on the front page or as a "pop-up".
  • The information contains information about which cookies are used, which information is processed, purpose and who processes the information. Electrocompaniet has chosen to add a link to the article you are now reading at the bottom of all pages. In the following, we will inform about the required information.

Electrocompaniet's website uses cookies that make the website remember previous user settings made on the page, such as the selected language, bandwidth or favorite place, and gives us statistics that we use to make our website better for the public. Electrocompaniet never uses cookies for the purpose of mapping individual users' usage patterns or other information that may violate privacy.
